Alternative Dispute Resolution
ADR has many paths, each of which are focused on lowering cost and increasing efficiency. Depending on the needs of the client, the posture of the dispute, the and the willingness of the opposing party, these paths include: conciliation (often religiously based), collaboration (parties and their attorneys), arbitration, and mediation.
Conciliation and collaboration involve attorneys representing each side in a cooperative negotiation that involves the free (and confidential) exchange of relevant information and targeted efforts at a win-win resolution without the escalation of litigation. Collaboration avoids court filings, depositions, hearings, etc., saves on the cost of a third-party mediator, and streamlines the negotiation process. Attorneys representing clients in the collaborative process are not permitted to represent the parties in litigation, incentivizing everyone to reach an efficient, private resolution.
Arbitration is effectively a privatized court process in which a single or often panel of three arbitrators adjudicate the matter after discovery, submitted statements, and an arbitral hearing (similar to bench trial).
Mediation is a process that involves a neutral third-party to assist both sides in moving towards a mutual resolution.
